By accessing or using Clinched (“the Service”), available at clinched.io, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by Clinched, a sole proprietorship based in Florida.

02Description of Service

Clinched is an AI-powered job search intelligence platform designed for executive-level professionals. The Service generates Intel Reports that may include company research, competitive analysis, culture signals, and role-specific planning content based on information you provide.

03Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.

04Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@clinched.io if you suspect unauthorized access.

05Payment and Subscriptions

Access to paid features requires a valid payment method. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on the applicable billing cycle.

• —We reserve the right to change pricing with at least 14 days’ notice.
• —Failure to maintain a valid payment method may result in suspension or termination of your account.

06AI-Generated Content Disclaimer

The Intel Reports and other content produced by Clinched are generated using artificial intelligence, including models provided by Anthropic. This content is provided for informational purposes only.

• —Nothing in the Service constitutes professional career advice, legal advice, financial advice, or any other form of regulated professional guidance.
• —Clinched makes no representations or warranties regarding the accuracy, reliability, or fitness of AI-generated content for any particular purpose.
• —You are solely responsible for how you use and act on any content generated by the Service.

07User Content

By uploading a resume or connecting your LinkedIn account, you grant Clinched a limited, non-exclusive license to process that content solely for the purpose of delivering the Service to you. You retain ownership of your content. We do not sell your resume or LinkedIn data to third parties.

08Prohibited Uses

You agree not to:

• —Use the Service for any unlawful purpose
• —Attempt to reverse-engineer, scrape, or exploit the Service or its underlying AI systems
• —Upload content you do not have the right to share
• —Misrepresent your identity or affiliation
• —Interfere with the security or integrity of the Service

09Indemnification

You agree to defend, indemnify, and hold harmless Clinched and its service providers (including Anthropic) from and against any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Service in violation of these Terms, content you submit, your violation of any applicable law, or any misuse of AI-generated outputs.

This indemnification obligation survives termination of your account and these Terms.

10Intellectual Property

All Service infrastructure, branding, design, and non-user-generated content are owned by Clinched. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license to use the Service as intended.

11Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to access the Service ceases immediately.

12Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLINCHED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO CLINCHED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida.

15Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use after changes take effect constitutes your acceptance of the revised Terms.

We do not sell your personal data. We do not use your resume or LinkedIn data for advertising purposes.

03AI Processing of Your Data

Content you upload is transmitted to Anthropic’s API for the purpose of generating your Intel Reports. This processing is performed on our behalf under Anthropic’s data usage policies. We do not use your personal data to train AI models, and we do not authorize Anthropic to do so on our behalf under our current agreement.

05Data Retention

We retain your account data and uploaded content for as long as your account is active. To request deletion, contact us at contact@clinched.io. We will process deletion requests within 30 days to the extent technically feasible.

06Security

We implement industry-standard security measures including encrypted data transmission (TLS), access controls, and secure credential storage via Supabase. No system is completely secure; we cannot guarantee absolute security of your data.

07Children's Privacy

The Service is not directed to individuals under 18. If you believe a minor has provided us with personal data, contact contact@clinched.io and we will delete it promptly.

08Your Rights

Regardless of your jurisdiction, you may access, correct, request deletion of, or withdraw consent for your personal data. Contact contact@clinched.io to exercise any of these rights.

09Cookies and Tracking

We use essential cookies and session tokens necessary to operate the Service. We do not currently use third-party advertising cookies or behavioral tracking.

10Changes to This Policy

We may update this Privacy Policy periodically. Material changes will be communicated via email or a notice within the Service. Continued use after changes take effect constitutes acceptance of the updated policy.

11Governing Law

This Privacy Policy is governed by the laws of the State of Florida. Disputes shall be subject to the jurisdiction of courts in Palm Beach County, Florida.
